This Privacy Policy explains how personal information about you is collected, used and disclosed by Charterly. This Privacy Policy applies to information we collect when you access or use our websites, apps and services (collectively, the "Services"), or when you otherwise interact with us. By visiting and/or using the website/App, the user/customer agrees to the following terms and conditions under this Privacy Policy.

1. Scope and Application

This Privacy Policy applies to persons who use our Site/App or Services. This Policy does not apply to information we collect from or about drivers, transportation companies, or any other persons who use the Charterly platform under license (collectively "Motor Carriers").

2. Security

We take commercially reasonable steps to help protect your personal information and to prevent its loss, misuse, unauthorized access, disclosure, alteration, or destruction. The information we collect is governed by the applicable laws of the Commonwealth of Virginia. We retain your data as long as needed to maintain communication with you and for our operational records. Your personal information may be stored and processed in various locations around the world, always under secure conditions with strictly controlled access.

Charterly employs physical, technical, and managerial safeguards designed to protect the integrity and confidentiality of your personal information. However, no method of transmission or storage is completely secure. As such, Charterly cannot guarantee the absolute security of the information you provide or store through our services—you share it at your own risk. Similarly, we cannot guarantee that data will never be accessed, disclosed, altered, or destroyed due to a breach of our safeguards.

If we become aware of a security breach, Charterly may notify you electronically so you can take appropriate protective actions. We may also post a notice on our platform. Depending on your location, you may have the legal right to receive written notification of a security breach. To request a written notice, please contact us at charters@thecharterly.com.

All personal information you provide is treated as confidential. Charterly does not sell or trade your personal data without your explicit consent. We only share information with Motor Carriers when necessary for them to provide transportation services to you. We do not otherwise share your information with third parties unless you’ve authorized it, or as outlined in our Privacy Policy. If you are not comfortable with your information being used in this manner, please refrain from using our site or app.

We are committed to safeguarding your information. Our systems are designed with up-to-date technology, policy enforcement, and security measures to prevent unauthorized access or misuse of your personal data. Our practices are regularly reviewed to ensure compliance with relevant laws and industry standards.

We do not rent, sell, or share your personal data with other companies for their marketing purposes without your consent. However, we reserve the right to disclose your information to third parties if required to comply with lawful government or legal requests.

3. Customer's Obligations

You must only submit to us or our agents, affiliates or the Site/App information which is accurate and not misleading and you must keep it up to date and inform us of changes. Your actual details may be stored with us and you may access this information by logging into your account on the Site/App. You undertake to treat the personal access data confidentially and not make it available to unauthorized third parties. We cannot assume any liability for misuse of passwords unless this misuse is our fault.

4. Types of Information We Collect

We may collect login information, personal information, location, transaction, device info, call/SMS data, etc.

Login Information

We collect information about your interactions with our Services, including when and how you access them. This may include data such as login timestamps, pages visited, features used, browser type and language, and your Internet Protocol (IP) address. Additionally, we collect information when you download or install our app, communicate with us through third-party social media platforms, request customer support, or otherwise interact with us.

Personal Information

We collect personal information that you voluntarily provide through web forms—such as during account registration, when accessing the user portal, or when submitting requests for information. This includes information that can uniquely identify or contact you, such as your name, email address, telephone number, mailing address, and any other information you choose to share with us. We may also collect information about your activities or preferences when linked to your personal information. Please note that this does not include aggregate or anonymized data, which cannot be used to identify you individually. This Privacy Policy does not restrict our ability to collect and use aggregate or non-personal information.

Location Information

When you use our Services to book transportation, we collect precise location data related to your trip, which is shared with Motor Carriers as necessary to provide service. If you allow the Charterly app to access your device’s location through your mobile operating system’s permission settings, we may collect your precise device location while the app is running in the foreground or background. We may also infer your general location based on your IP address.

Transaction Information

We collect details about your transactions when using our Services. This includes the type of transportation booked, trip date and time, fare amount, distance traveled, and other transaction-related details that help us provide and improve our services.

Device Information

We may collect information about the device you use to access our Services. This can include your device's hardware model, operating system and version, unique device identifiers, advertising identifiers, software and file versions, language preferences, serial number, device motion data, and mobile network information.

Call and SMS Data

To facilitate communication between users and Motor Carriers, our Services may transmit phone calls and SMS messages. In doing so, we collect data such as call and message timestamps, the phone numbers involved, and the content of SMS messages exchanged. This data is collected solely to provide and support communication functionality within the platform.

5. Use of Information

We may use your information to provide, maintain and improve our services, send you relevant information, process transactions, and more.

  • Provide, maintain, and enhance our Services. This includes processing payments, sending receipts, fulfilling your service requests (and sharing related information), developing new features and safety tools, offering customer support for both users and Motor Carriers, verifying user identities, and sending product updates or important administrative messages.
  • Support internal operations such as preventing fraud and abuse, diagnosing and fixing software issues, conducting data analysis, testing, and research, and monitoring usage patterns and activity trends.
  • Facilitate communications between you and Motor Carriers, including sending estimated arrival times and other relevant updates.
  • Send you communications we believe may interest you, such as information about products, services, promotions, news, and events from Charterly and affiliated companies—always in accordance with applicable laws. This also includes managing contest, sweepstakes, or promotion entries and distributing any associated prizes.
  • Personalize and improve your experience by offering tailored features, content, social connections, recommendations, referrals, and advertisements.

6. Sharing of Information

We may share your information with Motor Carriers, vendors, affiliates, in legal proceedings, etc., where applicable.

  • With Motor Carriers to provide the transportation services you request, including sharing your name, photo (if provided), and trip details.
  • With third-party partners who help deliver services or promotions you’ve requested or authorized, including apps and websites integrated with our Services.
  • Publicly, if you post content in publicly accessible areas such as social media or blog comments.
  • With Charterly affiliates, vendors, and service providers who assist us in operating our business and providing services.
  • When required by law or legal process, or to protect the rights, property, or safety of Charterly, users, or others.
  • During business transactions such as mergers, acquisitions, or asset sales.

8. Cookies

We use cookies for identification and access control. You can choose to disable cookies in your browser settings.

12. Privacy Settings

While Charterly may provide options to adjust your privacy settings and limit access to certain personal information, please understand that no security system is 100% secure. Charterly is not liable for any breaches or bypassing of privacy settings or security measures on the Service. Additionally, we cannot control how other users handle the information you choose to share with them. Even after you remove content from the Service, it may still exist in cached or archived copies, or be saved by other users or third parties. Therefore, Charterly cannot guarantee that any information you post or transmit through the Service will remain private or inaccessible to unauthorized individuals.

14. Legal Disclaimer

We reserve the right to disclose your personal data if required by law or to protect our rights or others.

15. Changes and Updates to This Policy

This policy may be updated from time to time. We recommend reviewing this page periodically.

16. Third Party Integrations

If you sign up or log in via a third-party service like Google or Facebook, we may receive data as per their policies.

With your analytics consent, Google Ads also receives a conversion event only after our server accepts your quote request. Advertising storage, advertising user-data consent and ad personalization remain disabled. We do not include your form details in this event. This limited measurement may not attribute every conversion to an advertisement.

Optional campaign analytics

With your consent, this campaign landing page uses Google Analytics 4 to measure page visits, successful quote requests, phone-link clicks and email-link clicks. A click does not confirm that a call or email was completed. Google may process cookie identifiers, device/browser information and network information to provide analytics. Data may be processed outside your country.

We do not send quote form contents, names, phone numbers, email addresses, trip details, raw page query strings or referring URLs to our analytics events. Only explicitly approved campaign labels may be included. Advertising personalization and Google signals are disabled in this site's configuration.

Analytics is off until you select Accept analytics. Rejecting it does not affect quotes or contact links. Your choice is stored on this browser for up to 180 days. Use Analytics settings on any campaign page to withdraw consent; this stops future measurement and removes this campaign's analytics cookies. Withdrawal does not erase data already collected.
